شروط الاستخدام
1. القبول
بإنشاء حساب أو استخدام تطبيق VyaTrip فإنك توافق على هذه الشروط وعلى سياسة الخصوصية. إذا لم توافق فلا تستخدم الخدمة.
2. الأهلية والحساب
- يجب أن يكون عمرك 18 عاماً على الأقل وأن تقدم بيانات صحيحة ومحدّثة.
- أنت مسؤول عن سرية حسابك وعن كل نشاط يتم من خلاله. أبلغنا فوراً عن أي استخدام غير مصرح به.
- حساب واحد لكل شخص، ولا يجوز نقله أو بيعه.
3. طبيعة الخدمة
تعمل VyaTrip كمنصة ووكيل لحجز خدمات يقدمها مزوّدون مستقلون (شركات الطيران، الفنادق، شركات التأمين وتأجير السيارات، الجهات المختصة بالتأشيرات، والسائقون المسجلون). تخضع كل خدمة أيضاً لشروط مزوّدها، والتي تُعرض عند الحجز عند توفرها.
4. الحجوزات والأسعار
- تُعرض الأسعار بالدينار الليبي (LYD) ما لم يُذكر غير ذلك، وقد يُعرض سعر تقريبي بعملة أخرى للعلم فقط.
- لا يُعتبر الحجز مؤكداً إلا بعد إتمام الدفع وصدور رقم مرجعي.
- أنت مسؤول عن صحة بيانات المسافرين ومطابقتها لجوازات السفر، وعن امتلاك وثائق السفر والتأشيرات المطلوبة.
- أجرة التاكسي المعروضة تقديرية بناءً على المسار المتوقع، وقد تختلف الأجرة النهائية حسب المسار الفعلي والوقت والتسعير المعتمد.
5. الدفع والمحفظة
- تتم مدفوعات البطاقات عبر مزوّد دفع مرخّص (T-Lync / Plutu). ولا نحتفظ ببيانات بطاقتك.
- رصيد المحفظة يُستخدم داخل التطبيق فقط، ولا يُنقل لحساب آخر، ولا يترتب عليه أي فوائد.
- عند تعذر إتمام حجز بعد الدفع، يُضاف المبلغ إلى محفظتك أو يُعاد حسب سياسة الاسترداد.
6. الإلغاء والاسترداد
تختلف سياسة الإلغاء حسب الخدمة والمزوّد وتُعرض قبل التأكيد (مثلاً: «إلغاء مجاني حتى 24 ساعة» للفنادق). قد تُطبق رسوم إلغاء. رسوم التأشيرات غير قابلة للاسترداد عادة بعد تقديم الطلب للجهة المختصة.
7. خدمة التاكسي
- العملاء: حدّد نقطة الالتقاء بدقة، وكن متواجداً في الوقت المحدد، وتعامل باحترام مع السائق والمركبة.
- السائقون: يجب امتلاك رخصة قيادة سارية ومركبة مرخصة ومؤمّنة، والالتزام بقوانين المرور، والموافقة على مشاركة الموقع أثناء الرحلة. يُخصم من محفظة السائق نسبة عمولة VyaTrip المعلنة، ويجب الحفاظ على الحد الأدنى للرصيد لاستلام الرحلات.
- يحق لنا تعليق الحسابات عند وجود شكاوى جدية أو مخالفة للسلامة.
8. التأشيرات
نساعدك في تجهيز وتقديم طلب التأشيرة، لكن القرار النهائي بالموافقة أو الرفض يعود للجهة المختصة وحدها، ولا نضمن صدور التأشيرة أو مدة معالجتها.
9. الاستخدام المحظور
- تقديم بيانات أو مستندات مزورة أو لا تخصك.
- إساءة استخدام المدفوعات أو المحفظة أو محاولة الاحتيال.
- مضايقة السائقين أو العملاء أو فريق الدعم، أو استخدام الدردشة لأغراض غير مشروعة.
- محاولة اختراق التطبيق أو الخوادم أو استخراج البيانات آلياً.
10. الملكية الفكرية
التطبيق وتصميمه وعلامته التجارية ملك لـ VyaTrip. يُمنح لك ترخيص شخصي غير حصري لاستخدامه للأغراض المشروعة فقط.
11. إخلاء المسؤولية وحدودها
نقدم الخدمة «كما هي». لا نتحمل المسؤولية عن تأخير أو إلغاء أو تقصير المزوّدين المستقلين، أو عن الظروف الخارجة عن إرادتنا (القوة القاهرة). وفي حدود ما يسمح به القانون، لا تتجاوز مسؤوليتنا المبلغ الذي دفعته مقابل الحجز المعني.
12. إنهاء الحساب
يمكنك حذف حسابك في أي وقت من التطبيق أو عبر صفحة حذف الحساب. ويحق لنا تعليق الحساب أو إغلاقه عند مخالفة هذه الشروط.
13. التعديلات
قد نعدّل هذه الشروط، وسنعلن عن التغييرات الجوهرية قبل سريانها. استمرارك في استخدام الخدمة بعد السريان يعني موافقتك.
14. القانون الواجب التطبيق
تخضع هذه الشروط لقوانين دولة ليبيا، وتختص محاكم طرابلس بالنظر في أي نزاع، مع عدم الإخلال بحقوق المستهلك المقررة قانوناً.
15. التواصل
Terms of Use
1. Acceptance
By creating an account or using the VyaTrip app you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Eligibility and account
- You must be at least 18 years old and provide accurate, up-to-date information.
- You are responsible for keeping your account secure and for all activity on it. Tell us immediately about any unauthorised use.
- One account per person; accounts may not be transferred or sold.
3. Nature of the service
VyaTrip is a platform and agent for booking services provided by independent suppliers (airlines, hotels, insurers, car-rental companies, visa authorities and registered drivers). Each service is also subject to its supplier's terms, shown at booking where available.
4. Bookings and prices
- Prices are shown in Libyan dinars (LYD) unless stated otherwise; an approximate price in another currency may be shown for information only.
- A booking is confirmed only after payment is completed and a reference number is issued.
- You are responsible for traveller details matching passports, and for holding the required travel documents and visas.
- Taxi fares shown are estimates based on the expected route; the final fare may vary with the actual route, time and applicable pricing.
5. Payments and wallet
- Card payments are processed by a licensed payment provider (T-Lync / Plutu). We do not store your card details.
- Wallet balance can only be used in the app, cannot be transferred to another account, and earns no interest.
- If a booking cannot be completed after payment, the amount is added to your wallet or refunded according to the refund policy.
6. Cancellations and refunds
Cancellation rules vary by service and supplier and are shown before you confirm (for example, "free cancellation up to 24 hours" for hotels). Cancellation fees may apply. Visa fees are usually non-refundable once the application is submitted to the authority.
7. Taxi service
- Riders: set your pickup point accurately, be on time, and treat drivers and vehicles with respect.
- Drivers: you must hold a valid driving licence and a registered, insured vehicle, obey traffic laws, and agree to share your location during trips. VyaTrip's published commission is deducted from the driver wallet, and the minimum balance must be maintained to receive trips.
- We may suspend accounts after serious complaints or safety violations.
8. Visas
We help prepare and submit visa applications, but the final approval or refusal rests solely with the competent authority. We do not guarantee that a visa will be issued or how long processing takes.
9. Prohibited use
- Submitting false documents or data, or documents that are not yours.
- Misusing payments or the wallet, or attempting fraud.
- Harassing drivers, riders or support staff, or using chat for unlawful purposes.
- Attempting to hack the app or servers, or scraping data.
10. Intellectual property
The app, its design and brand belong to VyaTrip. You receive a personal, non-exclusive licence to use it for lawful purposes only.
11. Disclaimers and limitation of liability
The service is provided "as is". We are not liable for delays, cancellations or failures of independent suppliers, or for events beyond our control (force majeure). To the extent permitted by law, our liability is limited to the amount you paid for the booking concerned.
12. Termination
You may delete your account at any time in the app or via the account deletion page. We may suspend or close accounts that breach these Terms.
13. Changes
We may change these Terms and will announce material changes before they take effect. Continuing to use the service after that date means you accept them.
14. Governing law
These Terms are governed by the laws of Libya, and the courts of Tripoli have jurisdiction, without prejudice to mandatory consumer rights.
